Our new conference, chaired by Clare Bone of Brodies, will take an in depth look at the most important legal developments from director and employee liability, legal privilege and safety policy offshore to health-related issues in the workplace, sentencing and fire safety. A keynote update from COPFS will also be included in the programme.

Between confidentiality and compliance: navigating privilege in regulatory investigations
When an incident occurs, the first steps taken by legal advisors can determine the scope and survival of legal privilege throughout the investigative process. For solicitors advising clients under scrutiny by Police Scotland or regulatory authorities, understanding how privilege is created, maintained and challenged is critical. Legal privilege remains a cornerstone of client protection but in the world of criminal and regulatory investigations, it is increasingly tested by investigative demands, data-sharing expectations and evolving case law. This session will examine recent developments in the law of privilege, practical steps to secure protected communications in the aftermath of an incident and the strategic value of privilege in managing regulatory investigations.

Enforcement of health-related issues in the workplace
With HSE’s continued focus on health, this session will provide an overview of the current regulatory approach to enforcing health related issues in the workplace. As well as looking at HSE inspection and enforcement we will provide some practical tips to assist clients facing scrutiny by the regulator.

Fire safety – similarities and key differences from the world of health and safety
An overview of the key duties and defences will be considered in this session along with strict liability rules, enforcement options and the regulatory approach. Key issues to consider in fire safety cases will also be discussed.

Sentencing update
Gavin will examine how the updated sentencing guidelines address fines for very large organisations. He shall also consider the extent to which compensation orders may be an appropriate sentencing option in health and safety prosecutions.
